Ila was born in Chester County, in July, 1773. Ilia father's family having removed to Northumberland County, was driven back in 1777 by tho Indians. In 1813, under his commission from Governor Snyder, ho was ordered out in command of his regiment by Major General Mend, and assisted in irotectino tho vessels built by Captain Perry. In 111 10 was again ordered out, in consequence of the burning of Puftalo, and a threat made by tho Ilritfdt to destroy the vessels in. the harbour of Eiie. In 131H he was commissioned as an Alderman for Lancaster hv Governor Fiudlav, hen qs Notary Public, and in 1813 as As Bociato Judge of tho Courts of Quarter Sessions and Common Plena, for Lancaster County, which station ho held until his death. reds, from fair to prime, is 80 a P3 arid Southern do. 80 a 83 cts. per bu-diol Rve, (0 a f5 cts; Yellow Corn, steady at 53 cts. Southern Oats, 23 per Cleared last week, Go8 bbls Corn for the West Indies. Kicc Is selling in small lots, at a 3 cts per lb cleared.

70 casks. Seeds New Flaxseed is coming to market pretty freely, and the price has declined to $1,43, at which rate sales havn been made. Sugar Within a few days the sales of Mtucova-does have been large, and since tho new Taritf tho rates generally have advanced about one cent per lb; sales of Brazil white, at 8 a cents per pound. Teas Maintain full rate prices, especially for the finer kinds, while the poor sorts nre plenty and dull. Tobacco Prices remain low', but there is a better feeling; and an improvement looked for by holders.

Preamble and Resolutions accompanying a Report from a committee of the New Garden Temperanco Society, communicated to the county society, at the meeting on the 4th of July last, and then referred, by the county society, to a committee consisting of T. llaines, J. J. Lewis, P. F.

Smith, Wm. Darlington and U. V. Penny-packer, Esqrs, Whereas, the law of 1834 allows the privilege of selling liquors to all such houses of entertainment as may bo necessary to accommodate the public and entertain strangers and travellers: And, whereas by the law of 1842, the license is restricted to the sale of liquors only, therefore Resolved, That the obligation formerly resting on our Courts to grant tavern li-censes for the implied purpose of providing entertainment for travellers, is virtually released by the law of 1841 unless, in the opinion of the said Courts, the sale of intoxicating drinks constilutes a necessary part of such entertainment. And whereas the law of 1841, very properly requires the publication of the petition and certificate prior to their presentment to the Court, therefore, Resolved, That the said provision fully implies the right of remonstrance, and that the representations thus made to the Court constitute a part of the evidence sought for and obtained, and ought to have due influence in determining the grant.

The committee to whom, by a resolution of the Chester County Temperance Society, was referred the communication from the Temperance Society of New Garden, the subject of the powers of the Court to grant or withhold Tavern licenses," having considered the "same, beg leave to make the following: Report. Presuming, from the organization of the committee, that the object of the society from which, it originated, was to obtain a legal opinion on' the question above stated, your committee db not deem it proper to answer the questions relating to moral duty, contained in the communication, nor to express their individual opinions on the propriety of the practice of granting or withholding licenses. The recent laws have not changed the powers of the Court in reference to this subject. These powers have not been enlarged or restrained since the passage of the act of 1710, which required licences to be granted, and made it penal to have or keep any public Inn, Tavern, without a license by the proper authority. Numerous modifications with a view to the collection of revenue, as well as to public utility and necessity, have been made, and b'the repository of the power lias been 'changed from time to time, until finally the Judges of the Courts of Quarter Sessions became the recipients under the law of 1815, and have so continued up to the present time.

The mode and manner of applications have been changed the evidence of the necessity public inns or Taverns, has been pointed out, and preliminary action required, which have limited the exercise of the discretion of the Court; but the power has not been changed. The power to grant implies the powerto withhold. This power is conferred, however, to be exercised in the performance of a duty. It is not an arbitrary power. A sound legal discretion in relation to the wants of the whole community must be regarded in its exercise.

The Court is not bound to grant upon the recommendation of twelve respectable citizens, nor to withhold upon the remonstrance of a much larger number. To do either in all cases, would be an arbitrary display of the power without regard to its corresponding duty. The inquiry is whether such Inn or Tavern is necessary to accommodate the public and entertain strangers and travellers. If the Court believe such to be the fact, their duty requires them to grant it a license. If they consider it unnecessary, the license ought to be withheld.

T.he evidence for or against it, may be derived from various sources, but can only be conclusive when it satisfies the mind of the Court on the one side or the other. Townsend Haines. Joseph J. Lewis. P.

Accepted, and upon being amended were adopted. Resolved, That it is our decided judgment that a period lias fully arrived when it is only the willfully blind that do not see a gross inconsistency in opposing crime and pauperism, and at the same time withholding their names from the temperance pledge. Resolved, As the opinion of this convention, that the purchasing of alcoholic liquors by temperance men, for persons who are not members of any temperance society to drink, is a violation of the temperance pledge, and that the local societies throughout the county be recommended to deal with all such accordingly. On motion it was resolved, That the different local societies should pay into the Treasury of this society, annually, the sum of one dollar for every hundred members, and pro rata for fractions under the same. On motion it was resolved, That the Treasurer be ordered to pay to the corresponding Secretary, the amount of expenses he has incurred in performing the duties of his office.

On motion it was resolved. That the corresponding secretary be at liberty to pledge the payment of the travelling expenses of invited lecturers who shall he requested to lecture before this society; that he shall be restricted in extending his invitation to more than two, and these within the distance of one hundred miles. As there was no more business before the society, invitations were extended to the Rev. James B. Ayers, Rev.

Wm. Lat-ta, Dr. Sumner Stebbins and Joshua S.
